Terms of Service

Last updated: October 10, 2026 · Effective date: October 10, 2026

What changed on October 8, 2026: section 8 now describes the branding kit that comes with your plan.

Neon on Main is a business based in Rockwall, Texas, USA. In these terms, "we," "us" and "Neon on Main" mean Neon on Main. "You" means the business that signs up or buys from us.

These terms cover neononmain.com, our customer portal at app.neononmain.com, previews, text messages, the website we build and run for you (together, the "Service"). Our Privacy Policy explains how we handle personal information.

The short version. The full terms below are what count.

  • We build, host and update your business website on a monthly or yearly plan, at the price shown when you sign up.
  • Any free trial offered to you is shown before you sign up. With a trial, we take your card at the start and charge you when the trial ends unless you cancel first. Without one, you pay when you sign up.
  • Changed your mind? Ask within 14 days of your first charge, or of a yearly renewal, for a full refund. After that, there's no refund for the rest of a month or year you've paid for.
  • Nothing goes live until you approve it.
  • You own your content and your domain.
  • Cancel anytime in the portal or by email.

1. Who can use the Service

Businesses in the United States. We offer the Service to businesses located in the United States. We don't currently offer it to businesses outside the US.

The Service is for businesses. You must be at least 18 and allowed to act for the business you sign up. If you sign up for a company, "you" means that company. If you're a sole trader, "you" means you, acting for your business.

You accept these terms when you agree to them at sign-up or checkout. Getting a preview or an email from us doesn't make you a customer. It doesn't let us charge you, and it doesn't give us any rights in your content.

If the law treats you as a consumer for a purchase, the consumer protections in these terms apply to you. Nothing here takes away rights that the law says we can't take away.

2. What your plan includes

We build a website for your business, host it at your domain, and keep it up to date while your plan is active. You can ask for changes in the portal.

Any agreed dates, extras and third-party requirements are in your order. We don't promise any particular search ranking, sales or traffic.

3. Your account and approvals

Keep your email address and contact details up to date. We sign you in with one-time codes sent to your email, so keep your email account secure. Tell us right away if you think someone else got in.

Tell us who can ask for or approve changes. You're responsible for instructions from people you authorize. That doesn't make you responsible for our own mistakes.

Before we publish your first website, and before each change, we show you a preview. Someone you authorize must approve it. Please check facts, prices, images, links and any legal wording carefully. AI-assisted work can contain mistakes.

Approving a preview lets us publish that change as shown. It doesn't excuse us from publishing it correctly, or from doing our work with reasonable care and skill.

4. Free trials

We may offer some new customers a free trial. Whether you're offered one, and how long it lasts, is shown on your preview and at checkout before you sign up. If you aren't offered a trial, your plan starts, and you pay for your first month or year, when you sign up. The rest of this section applies only if you start a free trial.

We collect your payment card when the trial starts. Checkout shows your plan, the exact date and time the trial ends, the first charge, any taxes, and how to cancel.

Unless you cancel before the trial ends, your paid plan starts automatically and we charge your card for the plan you picked. A yearly plan is charged for the full year at that point.

We email you when the trial starts, and again before it ends. You can cancel in the portal or by emailing billing@neononmain.com. If you cancel before the deadline, you aren't charged, even if we process it later.

If you cancel during the trial, there's no plan charge. Trying the Service never bills you for a preview or extra AI edits. Anything you buy separately, with your approval, follows its own order and refund terms.

Your trial may start before you approve your live website, as shown at checkout. If a delay on our side stops you from getting the trial, email billing@neononmain.com and we'll extend the trial or fix the charge.

5. Prices, renewals and payment

Prices are in US dollars. You pay the price shown when you sign up or buy (or in your dashboard), and we show it before you pay:

Taxes. Any taxes and the total are shown before you pay.

Renewals. Plans renew automatically for the same period until you cancel. Checkout asks you to agree to the recurring charge. We send a receipt after every charge. For yearly plans, we remind you at least 30 days before each renewal.

Switching plans. You can switch plans in your dashboard. Switching from a monthly plan to a yearly plan is charged right away (less a credit for the unused part of your current month) and starts a new paid year. Switching from a yearly plan to a monthly plan takes effect at the end of the year you've paid for: nothing changes before then, and from then on you're charged monthly. During a free trial, a switch applies to your first charge.

Price changes. We give you at least 30 days' notice. A new price applies no earlier than your next renewal after that notice. It never changes a period you've already paid for, and you can cancel before it applies.

Who you're buying from. Neon on Main is the seller. Stripe processes payments for us, but Stripe isn't the seller. We handle taxes, billing questions and refunds: email billing@neononmain.com. We never receive or store your full card number or security code.

Failed payments. If a payment fails, we'll tell you and may try again. If it's still unpaid 14 days after we tell you, we may pause your site, and we'll tell you how to turn it back on. We never hold your domain or content hostage over a bill.

6. Cancelling and refunds

Cancel anytime in the portal or by emailing billing@neononmain.com. We'll confirm by email, with the date your service ends. You don't have to call us or give a reason.

When you cancel, we stop the renewal and you keep your site for the rest of the time you've paid for. There's no exit fee. If you ask for a full refund within the 14 days, your service ends when we get your request.

We send approved refunds within 14 days, usually to the card you paid with. Your bank may take a few more days to show it. We don't deduct any fees.

Other purchases. Anything else you buy from us follows the terms shown when you order it. If something you bought is faulty or never arrives, we'll fix it or refund it. AI top-ups are covered in section 7.

If we can't fix a serious problem with the Service within a reasonable time after you tell us, you can end the affected service. We'll refund any prepaid time you haven't used, plus anything else the law gives you.

None of this limits your rights about unauthorized charges or faulty service, or any other right the law gives you that can't be waived.

7. AI editing and your monthly allowance

We use AI tools, including Anthropic's Claude models through its commercial service, to help prepare text, code and changes to your website. Your content and instructions may be processed by those tools, as our Privacy Policy explains. We don't use your private content to train AI models, and we don't sign it up for any provider's training programs.

A person you authorize approves everything before it's published. AI output can be wrong, incomplete, or similar to output made for others, so please check it. We don't promise that AI-made material is unique or protected by copyright.

Your monthly allowance. Every plan (monthly and yearly, and any free trial) includes a monthly allowance of AI-prepared edits, for normal, fair use. It resets on the 1st of each calendar month. Unused edits from the monthly allowance don't carry over. Big requests use more of the allowance than small ones. The portal shows how much you have left.

Top-ups. If you run out, you can buy a top-up. We show the price, any tax, and what it adds, and you approve each one yourself. There are no automatic top-ups and no surprise overage charges. Top-up edits don't expire at the end of the month: any you don't use carry over to later months until you use them. We use your monthly allowance first, then your top-up edits.

If your service ends before you've used all your top-up edits, we refund the unused part of what you paid for them. Included edits have no cash value. Edits can't be transferred or exchanged for cash, except for these refunds or where the law requires it.

If you run out, AI editing pauses until your allowance resets or you approve a top-up. Your website stays online, and you can still email us about problems or your account.

Previews. Businesses trying a preview get a small free allowance of edits. When it's used up, you can sign up to keep editing. Trying a preview never starts a paid plan by itself.

We won't cut your allowance during a period you've already paid for. If we change it for the future, we'll tell you in advance, and you can cancel.

8. Branding kit

When we make a branding kit for your business, it's included with your plan at no extra cost, and it's yours to use during a free trial too. A kit includes a refreshed version of your logo (with a version for dark backgrounds and a small square icon), your colors and fonts, a few notes on how your business sounds, 10 social media post designs with suggested captions, 3 posts announcing your new website, a cover image for your Google Business Profile, and an email signature.

Before you sign up, you can see your kit on your preview, marked with a "preview" watermark. Once your plan or free trial starts, the clean files are in your dashboard to download. If you cancel, you keep what we delivered, and we won't charge you for it after the fact.

Your kit is made from your own name, photos and details. Where you don't have a photo we need, we may use an AI-made image. Want something changed? Tell us and we'll update it. We don't register trademarks or run legal clearance searches.

Once your plan is paid, we transfer to you any copyright we own in your final kit materials and in final custom wording we write specifically for your paid website. This doesn't include our reusable tools or other people's material. It also doesn't claim rights that don't exist in AI-made material. A new logo we make with your website is yours right away, paid or not (section 9).

9. Your content, your domain, our software

You keep your rights in the text, photos, logos and files you give us or let us use ("Your Content"). Your domain stays yours. You handle its registration and renewal, unless your order includes that.

A new logo is yours to keep. If we make you a new logo with your website, it's yours to keep and use anywhere, free, even if you cancel, including during a free trial. We transfer to you any copyright we own in it, and your original logo stays yours too. You can switch your website back to your original logo at any time.

You let us store, copy, format, adapt and display Your Content as needed to run the Service. That covers previews, publishing changes you approve, backups and exports. Our service providers may process it only for those purposes.

This doesn't let us sell Your Content, use it to train AI models, or show it in our portfolio without your separate OK. It ends when your service and the return period in section 10 end, except for limited records we must keep by law.

You confirm you have the rights to the material and instructions you give us. That doesn't make you responsible for material we copied ourselves before you became a customer.

We own our reusable software, templates, platform, editor and systems, and the code and layout of the websites we build, except for the transfers in section 8 and rights you already had. While your plan is active, you can use your website for your business.

Open-source and other third-party parts keep their own licenses. We'll tell you if any of them seriously limit how you can use your site.

10. Taking your content and website with you

Free copy of your content. You can ask for a copy of Your Content, and any final custom materials you own, at any time while you're a customer or within 30 days after your service ends. That includes cancelling during a free trial. We send the files in common formats, free.

Your old website. When you sign up, we save a private copy of your old website's pages, as visitors saw them, for you to download anytime. It's a copy of the pages only, not of the system your old website ran on. We keep it like the rest of your content.

Ask while you're a customer or within 30 days after. We deliver within 10 business days (usually within minutes). If you ask in time, our deletion schedule won't get in the way.

11. Previews for businesses that aren't customers yet

We may build a private preview of a new website for a business before it signs up. To show what its new site could look like, the preview may use the business's own photos and text copied from its current website and public listings. We add public facts (such as hours, address and services) and our own design and writing.

12. Buy your website outright

We don't offer this right now.

13. Text messages

We don't send or receive text messages right now. If we add texting later, this section applies to it.

Texting is optional, and only offered where we support it. You don't need it to buy or use the Service. The portal and email always work.

If you text us first, we reply about that request, in that conversation only. That doesn't sign you up for recurring texts or promotions.

If you separately opt in to recurring service texts (by ticking a box that's left unticked for you), we may text you about your website, previews, approvals, support and account notices, including automated messages. Message frequency varies. Message and data rates may apply. Agreeing to texts isn't a condition of buying anything.

Reply STOP to opt out or HELP for help, or email hello@neononmain.com. We honor other reasonable ways of asking, too. We may send one non-promotional text to confirm you've opted out. After that, we use email or the portal for anything important. Opting out of texts doesn't cancel your plan.

We don't send promotional texts under this permission. Tell us if your number changes. Carriers aren't liable for delayed or undelivered messages, as far as the law allows. Don't use texts for emergencies, and don't assume a change is live until we confirm it.

14. Acceptable use and rights complaints

Don't use the Service for anything illegal, fraudulent, deceptive, infringing, hateful or harmful, or for harassment, malware or unauthorized access. We may decline a change or remove content that breaks these rules, and we'll tell you why.

Don't send us card security codes, government ID numbers, medical records or other highly sensitive records. Projects with regulated data need our written agreement first.

Data we handle for you. For personal information we handle on your behalf (for example, information on your website or sent through its contact forms), our Data Processing Agreement is part of these terms. It takes priority on those processing matters.

You're responsible for the truth and legality of what your business offers, and for any notices and permissions your site's own data collection needs (for example, analytics you ask us to keep). We stay responsible for our own legal duties and the work we agreed to do. We'll work with you on accessibility problems within the agreed service.

Rights complaints. Send copyright, trademark, privacy or other rights complaints to hello@neononmain.com. Tell us what the material is, where it is, what rights you have or who you act for, and how to reach you. We look into credible reports and may remove or restrict material. You don't need a formal notice for us to look at a complaint.

Copyright notices. Our Copyright and Takedown Policy explains how to send a formal copyright (DMCA) notice or counter-notice, and who our designated agent is. It's part of these terms. We may close the accounts of repeat copyright infringers, as that policy describes.

15. Availability and our responsibilities

We provide the Service with reasonable care and skill. We work to keep your site online and secure, but interruptions can happen. We can't promise uninterrupted access, error-free AI output, or protection from every security incident.

We take reasonable steps to fix faults, and we tell you about major interruptions when we can. We stay responsible for our legal duties, even though we use other companies to help run the Service.

If the law gives you rights or remedies about the quality of the Service that can't be waived, our refund policy doesn't replace them.

16. Liability

Nothing in these terms limits liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or anything else the law doesn't let us limit. Nothing limits your privacy rights that can't be waived, or a regulator's powers.

For business customers only, and subject to the paragraph above:

The limit never reduces refunds we owe you under these terms. These business-only limits don't apply to consumers. For consumers, the law decides our liability, including for losses our breach causes.

17. Claims about your content

This section applies to business customers only.

If someone claims that material you gave us, or an unlawful instruction from you, infringes their rights, you'll repay our reasonable, documented losses and legal costs, as far as that material or instruction caused them. This covers amounts a court awards against us, or a settlement you approve.

This doesn't cover our own negligence or wrongdoing, changes we made without your OK, material we found or copied ourselves (including anything we copied into a preview), or claims caused by our tools or conduct.

We must tell you promptly, let you run the defense with suitable lawyers, and cooperate. Neither of us may settle in a way that admits the other's fault, gives the other non-money duties, or fails to release the other, without the other's written OK. That OK won't be unreasonably refused.

18. Pausing or ending the Service

We may pause or end the Service for a serious breach of these terms, non-payment after the notice in section 5, or a serious legal or security risk. Where reasonable, we'll explain the problem and give you at least 14 days to fix it. Urgent risks may need immediate action, and we'll tell you afterwards when we're allowed to.

We may stop offering the Service for business reasons, with at least 30 days' notice. If we end your service early, we refund prepaid time you haven't used and any unused top-ups.

Your right to get your content (section 10) continues, unless a legal restriction stops us releasing particular material. Ending the Service never gives us your domain. Payments already owed, ongoing licenses, and terms meant to last after the end still apply.

19. Changes to these terms

We'll give you at least 30 days' notice of important changes, by email. Changes never apply backwards to a dispute or charge. Where the law requires it, we'll ask you to agree again.

If a change seriously reduces your paid service or your rights and you don't accept it, you can end your service before it takes effect and get a refund for prepaid time you haven't used. Changes required by law, or urgent security changes, may apply sooner. We'll explain why, and your cancellation rights still apply.

20. Governing law and disputes

Texas law governs these terms, without its conflict-of-laws rules. Unless mandatory law says otherwise, disputes go to the state courts in Rockwall County, Texas, or the US District Court for the Northern District of Texas, Dallas Division.

If the law where you're based gives you rights that can't be waived by contract, including about where you can bring a claim, this section doesn't take them away.

There's no forced arbitration and no class-action waiver in these terms. Please contact us first so we can try to fix a problem. You don't have to, though, before using a legal right or meeting a deadline.
